Changes to Ohio's Fireworks Laws
July 1, 2022: Change to Ohio’s fireworks laws. How does this impact Marietta residents?
What kind of fireworks can you use: Class 1.4G Consumer Grade Fireworks. Examples: Normal consumer used fire crackers, shells & mortars, roman candles, bottle rockets, sparklers, fountains, novelty items like airplanes, helicopters, and roses. If you are unsure if they are a legal firework then ask the retailer.
What times can you discharge fireworks: Between the hours of 4pm-11pm. (Anything after 11pm is subject to citation for disturbing the peace unless it’s an exempted holiday*.)
What days can you discharge fireworks: ONLY on the specific days listed:
- January 1st* (Can discharge from Midnight-1am)
- Chinese New Year’s Day
- May 5th
- Last Saturday, Sunday & Monday in May
- June 19th
- July 3,4,5th
- The First Fri, Sat, & Sun before and after July 4th
- The first Monday of September (and the prior Saturday & Sunday)
- Diwali
- December 31st* (Can discharge until 11:59pm)
Are there any restrictions: YES
- You must be 18 years old to handle and discharge fireworks.
- No one under 18 years of age shall be within 150 feet of the fireworks discharge.
- You must discharge the fireworks on private property (Not the street or alleys) and they must land/remain on the same private property. (Ex: Do not shoot bottle rockets onto the neighbor’s property).
- You CANNOT point, aim, or discharge any fireworks towards another person, animal, building, aircraft, watercraft, or emergency service personnel.
Tips for having fun with fireworks:
- Don’t drink alcohol and shoot off fireworks.
- Have a water source (garden hose or bucket of water) nearby in case of fires.
- Keep children and animals away from the discharge site.
*Remember that YOU are liable for any injuries, death or property damage that may occur from discharging fireworks inside the city limits*
The Marietta Police Department is asking that residents be responsible, safe, and courteous when handling and discharging fireworks. Please read Ohio Revised Code 3743.45 and Ohio Administrative Code 1301:7-7-56(z) for further details.
